EP criticizes EC for lack of action against Poland and Hungary

The European Commission must take urgent action and immediately apply the conditionality mechanism linked to the rule of law, says a resolution adopted on 9 March by the European Parliament. 478 MEPs voted in support, 155 voted against and 29 abstained.
In the adopted resolution, MEPs welcomed the recent ruling by the Court of Justice of the EU dismissing Hungary's and Poland's complaints against the rule of law conditionality mechanism regulation. CJEU found that the regulation is compatible with EU law and its rule of law powers. Now, according to the MEPs, it is time for the Commission to fulfill its duty as guardian of the Treaties and respond immediately to the current serious breaches of the rule of law "in some member states". In their view, the Commission's response to the CJEU rulings is "insufficient".
MEPs believe it is important to ensure that taxpayers' money never ends up in the pockets of those who undermine the EU's shared values. The rule of law conditionality mechanism should be applied to both the European Union budget and the NextGenerationEU package funds, they said.
Inaction and laxity towards oligarchic structures and systemic violations of the rule of law weaken the entire European Union and undermine the trust of its citizens, the resolution stressed.
European Commission Vice President Vera Jourova said that the CJEU's rejection of Poland's and Hungary's complaints against the conditionality mechanism means that it is "perfectly legal and useful." However, she stressed that the Commission was still examining Poland's and Hungary's responses to its rule of law concerns and it was not yet possible to indicate when and against which member state sanctions would be applied under the conditionality mechanism.
Jourova reminded that according to the CJEU guidelines, the mechanism will only be applied if the Commission has evidence that there is such a lack of rule of law that threatens EU finances. She added that Poland's proposals to reform the current procedure for disciplining judges are a "positive step".
